The purpose of these Regulations is to provide for a registration system of waste brokers and dealers who arrange for the shipment of waste to and from Ireland and also the passage of waste through the State. The regulations are necessary in order to comply with the provisions of Regulation (EC) No. 1013/2006 of the European Parliament and of the Council of 14 June 2006 on shipments of waste and Directive 2006/12/EC of the European Parliament and of the Council of 5 April 2006 on waste..

S.I. No. 86/2008 – Waste Management (Facility Permit and Registration) (Amendment) Regulations 2008

These Regulations amend the Waste Management (Facility Permit and Registration) Regulations 2007 to correct certain typographical errors and omissions. These Regulations also replace the Third Schedule of those Regulations (specifying the classes of activity which are subject to a Waste Facility Permit application to a Local Authority or subject to Registration with a Local Authority or the Agency).

S.I. No. 82/2008 – Sea Pollution (Control of Anti-Fouling Systems on Ships) Regulations 2008

These Regulations give effect to the International Convention on the Control of Harmful Anti-fouling Systems on Ships (AFS Convention), which was adopted by an International Conference on the Control of Harmful Anti-Fouling Systems for Ships, convened by the International Maritime Organization (IMO) from 1st to 5th October 2001.

This Convention prohibits the use of harmful organotins in anti-fouling paints used on ships and establishes a mechanism to prevent the potential future use of other harmful substances in anti-fouling systems.

These Regulations provide for the surveying and, if appropriate, subsequent certification of all ships entitled to fly the flag of the State, or which operate under its authority wherever they may be. All other ships may be subject to inspection when they are in the territorial waters of the State.

Section 29 of the Sea Pollution Act, 1991 provides for penalties for breaches of these Regulations.

S.I. No. 79/2008 – Bathing Water Quality Regulations 2008

These Regulations provide for transposition of the EU Bathing Water Directive 2006 (Directive 2006/7/EC of 15 February 2006) which aims—

•to improve health protection for bathers
•to establish a more pro-active approach to management of bathing waters, and
•to promote increased public involvement and dissemination of information to the public.

The Regulations establish a new classification system for bathing water quality based on four classifications "poor", "sufficient", "good" and "excellent" and generally require that a classification of at least "sufficient" be achieved by 2015 for all bathing waters. Local authorities must take appropriate measures with a view to improving waters which are classified as "poor" and increasing the number of bathing waters classified as "good" or "excellent". A permanent advice against bathing must be issued in a case where a bathing water is classified as "poor" for five consecutive years. Local authorities are required annually to identify bathing waters, establish a monitoring calendar, carry out the specified monitoring, report the results to the EPA, carry out appropriate management measures where necessary and provide information to the public. There must be public participation in the identification of waters and the general implementation of the Regulations. The EPA is required by the Regulations to classify bathing waters, generally on the basis of the monitoring results for the four preceding bathing seasons, and to publish an annual report in relation to bathing water quality. Monitoring by local authorities is to commence not later than 2011 with a view to ensuring that a classification is assigned to bathing waters not later than 2015. Private controllers of access lands may be required to contribute towards the costs incurred by a local authority or the EPA.

The Regulations will repeal and replace the Quality of Bathing Waters Regulations, 1992 ( S.I. No. 155 of 1992 ) with effect from 31 December 2014.

An Act to regulate and control the manufacture, use, placing on the market, export, import, transport, testing, storage, classification, labelling and packaging of chemicals; to make provision in relation to major accident hazards, and the prevention of accidents, involving chemicals; for those purposes to give further effect to regulation (EC) no. 304/2003 of the European parliament and of the council of 28 January 2003 concerning the export and import of dangerous chemicals ( 1), regulation (EC) no. 648/2004 of the European parliament and of the council of 31 march 2004 on detergents ( 2) and regulation (EC) no. 1907/2006 of the European parliament and of the council of 18 December 2006 concerning the registration, evaluation, authorisation and restriction of chemicals (reach) and establishing a European chemicals agency( 3) ; to confer power on the minister for enterprise, trade and employment to make regulations for the purpose of giving effect to certain provisions of the treaties governing the european communities and certain acts of the institutions of those communities; and to provide for matters connected therewith.

S.I. No. 846/2007 – Water Services Act 2007 (Commencement) Order 2007

This Order brings into operation certain general provisions of the Water Services Act 2007 ; also miscellaneous amendments to the Local Government (Water Pollution) Acts 1977 and 1990, the Fisheries (Consolidation) Act 1959 , the Environmental Protection Agency Act 1992 and, for the purposes of synchronisation, certain other enactments relating generally to the provision of water services; as well as the repeal of certain related enactments specified in the Schedule to the Order.

These Regulations amend and replace the Waste Management (Permit) Regulations 1998 and set out procedures for the making of permit and registration applications, public consultation, consideration by local authorities of submissions in relation to permit or registration applications, and the grant, refusal and review of facility permits and registration by local authorities.
