S.I. No. 59/2010 – European Communities (Conservation of Wild Birds (Ballycotton Bay Special Protection Area 004022)) Regulations 2010

Council Directive of 2 April 1979 on the conservation of wild birds (79/409/EEC) provides for the conservation of wild birds by, among other things, classifying important ornithological sites as Special Protection Areas for them. The effect of these Regulations is to designate a site as a Special Protection Area in accordance with Article 4 of the Directive and to provide that contravention of the provisions of these Regulations shall constitute an offence. Under Article 5 of the Directive all species of birds are afforded protection from disturbance, capture and damage to nests and eggs, not just the birds listed on Schedule 3 (with the exception of those birds covered under Articles 7 for hunting, and Article 9 where derogations are listed). Please note that operations/activities other than those listed at Schedule 4 to these Regulations, such as effluent discharge, planning permission, aquaculture, fishing or forestry require a licence or permission from the appropriate consent authority.

S.I. No. 48/2010 – Urban Waste Water Treatment (Amendment) Regulations, 2010

These Regulations amend the Urban Waste Water Treatment Regulations, 2001 byî (a) designating ten additional areas (in River Boyne, River Liffey, River Barrow, River Shannon, River Fergus, River Brosna, Tullamore River, Boyne Estuary, Clonakilty Harbour and Wexford Harbour) as sensitive areas, and (b) making some minor technical amendments. The Urban Waste Water Treatment Regulations, 2001 (as amended) impose requirements in relation to discharges from urban waste water treatment facilities and give effect to Directive No. 91/271/EEC (the Urban Waste Water Treatment Directive) and Directive No. 2000/60/EC (the Water Framework Directive).

These Regulations increase the landfill levy for waste disposed of at an authorised or unauthorised landfill facility from 25 per tonne to 30 per tonne with effect from 1 February 2010.

S.I. No. 13/2010 – Waste Management (Landfill Levy) Order 2010

This Order amends section 73(3) of the Waste Management Act 1996 as inserted by section 11 of the Waste Management (Amendment) Act 2001 and provides that the amount of the landfill levy shall not exceed 30.
