S.I. No. 109/2010 – European Communities (Conservation of Wild Birds (Mid-Clare Coast Special Protection Area 004182)) Regulations 2010

Directive 2009/147/EC of the European Parliament and of the Council of 30 November 2009 on the conservation of wild birds provides for the conservation of wild birds by, among other things, classifying important ornithological sites as Special Protection Areas for them. The effect of these Regulations is to designate a site as a Special Protection Area in accordance with Article 4 of the Directive and to provide that contravention of the provisions of these Regulations shall be an offence. The area now known as the Mid-Clare Coast SPA consists of an amalgamation of two pre-existing SPAs: Mutton Island (Site Code 004070) and Mattle Island (Site Code 004071). These areas were protected under Paragraphs 62 and 63 of the Schedule to the European Communities (Conservation of Wild Birds) Regulations 1985 ( S.I. No. 291 of 1985 ) which are being revoked and replaced by these Regulations. The area will now be known as the Mid-Clare Coast SPA. Under Article 5 of the Directive all species of birds are afforded protection from disturbance, capture and damage to nests and eggs, not just the birds listed in Schedule 3 (with the exception of those birds covered under Articles 7 for hunting, and Article 9 where derogations are listed). Please note that operations/activities other than those listed at Schedule 4 to these Regulations, such as effluent discharge, planning permission, aquaculture, fishery or forestry require a licence or permission from the appropriate consent authority.

S.I. No. 93/2010 – European Communities (Water Policy) (Amendment) Regulations, 2010

The European Communities (Water Policy) Regulations, 2003 ( S.I. No. 722 of 2003 ) as amended by the European Communities (Water Policy) (Amendment) Regulations, 2005 ( S.I. No. 413 of 2005 ) and by the European Communities (Water Policy) (Amendment) Regulations, 2008 ( S.I. No. 219 of 2008 ), provide for transposition of the EU Water Framework Directive 2000 (Directive 2000/60/EC). Those Regulations are amended as follows:î •the deadline for the relevant local authorities to establish environmental objectives in relation to each river basin district and to establish and publish the programmes of measures, and make and publish river basin management plans is extended to 30 April 2010 (and to 14 May 2010 where the making of such programmes and plans becomes an executive function); •the date by which the EPA must provide a report to the Minister in relation to the programmes of measures and the river basin management plans is amended to 31 May, 2010; •the date by which the Minister may, after consultation with any Minister of the Government, competent authority in Northern Ireland or other person as he considers appropriate, amend a programme of measures or a river basin management plan by notice issued to the co-ordinating authority is amended to 30 June 2010; and •the date on which the programmes of measures and the river basin management plans come into effect is amended to 9 July 2010. 1 O.J. S.I. No. 86/2010 – European Communities (Marine Equipment) (Amendment) Regulations 2010

The European Communities (Marine Equipment) Regulations 2009 ( S.I. No. 259 of 2009 ) are amended to transpose Commission Directive 2009/26/EC. This Directive is the latest amendment of Council Directive 96/98/EC on marine equipment. The purpose of the 1996 Directive (and of the amendments to it over the years) is to enhance safety at sea and to prevent marine pollution through the uniform application of the relevant international instruments relating to certain marine equipment. These regulations give effect to the latest amendment to replace the text in Annex A.1. to the 1996 Directive this annex sets out a list of marine equipment for which detailed testing standards already exist in international instruments. The regulations also provide that transitional arrangements apply until 6 April 2012 for certain marine equipment that was manufactured before 6 April 2010.
