IRISH ENVIRONMENTAL LEGISLATION

These Regulations provide for measures to protect the environment and human health by preventing or reducing the adverse impacts of the generation and management of waste and by reducing overall impacts of resource use and improving the efficiency of such use and transpose Directive 2008/98/EC of the European Parliament and of the Council of 19 November 2008 on waste and repealing certain directives, referred to in these Regulations as the waste directive. The vast bulk of the waste directive is already transposed by the Waste Management Act 1996 and various regulations made thereunder and where required the Regulations amend the 1996 Waste Management Act, provide for stand alone aspects not amenable for direct inclusion into the Act by way of specific amendments and also other consequential amendments to regulations affected by the transposition.

These Regulations amend Article 17 of the European Communities (Good Agricultural Practice for Protection of Waters) Regulations 2010 ( S.I. No. 610 of 2010 ). The purpose of this amendment is to allow a local authority to apply a landspreading restriction to the upstream catchment area and to the close proximity downstream of an abstraction point in the case of any surface waters.

These Regulations may be cited as the Chemicals Act (CLP Regulation) Regulations 2011

These Regulations, which relate to fisheries control systems and rules for the recording of fish catches, provide that a contravention of any provision of Commission Regulations is a contravention of the Sea-Fisheries and Maritime Jurisdiction Act 2006 .

These regulations provide for a system of on-the-spot fines to be administered by Inland Fisheries Ireland, as applies to fisheries legislation. The form of notice of an on-the-spot fine is set out in the Schedule to the Regulations.

Environment, Heritage and Local Government (Delegation of Ministerial Functions) Order 2011.

This Order brings into operation on the 1st February 2011, section 22, section 23 and subsections (b) to (j) of section 27 of the Energy (Biofuel Obligation and Miscellaneous Provisions) Act 2010 (No. 11 of 2010). This Commencement Order allows the statutory powers of Gas Safety Officers (GSO), appointed by the Commission for Energy Regulation, to be extended to the inspection and audit of Liquefied Petroleum Gas (LPG) fittings with respect to safety.

The effect of this Order is to amend the Open Seasons list of huntable species of wild birds by the addition of the species, Cock Pheasant and Woodpigeon for the period from 1st February 2011 to 28th February 2011, both dates inclusive, throughout the State exclusive of the areas specified in the Second Schedule of the Principal Order as amended.
