IRISH ENVIRONMENTAL LEGISLATION

This Order commences section 48 of the Environment (Miscellaneous Provisions) Act 2011 insofar as it relates to sections 188 , 191 and 194 (3) of the Local Government Act 2001 . It should be read in conjunction with the Local Government Act 2001 (Commencement) Order 2011.

These Regulations are to provide for the removal of the prohibition on fishing for cockles within a defined area of Dundalk Bay.

These Regulations revise and replace the Waste Management (Landfill Levy) Regulations 2008 and make provision for the continued operation of the landfill levy provided for under section 73 of the Waste Management Act 1996 . The Regulations increase the landfill levy for waste disposed of at authorised and unauthorised landfill facilities from 30 per tonne to 50 per tonne with effect from 1 September 2011

This Order provides for the commencement of sections 1 to 14 , 20 and 21 , and 43 to 47 of the Environment (Miscellaneous Provisions) Act 2011 , with effect from 23rd August 2011

These Regulations amend the European Communities (Health of Aquaculture Animals and Products) Regulations 2008 ( S.I. No. 261 of 2008 ) to, give effect to new measures introduced by Commission Decision 2011/187/EU as regards the approval of national measures for preventing the introduction of ostreid herpesvirus 1 var (OsHV-1uvar). The Regulations provide for the establishment of national measures in relation to OsHV-1 var, which will allow areas (bays) which are currently free of the virus to be protected in terms of trading with areas infected with OsHV- 1 var.

The purpose of these Regulations is to revoke the Waste Management (Waste Electrical and Electronic Equipment Regulations) 2005 ( S.I. No. 340 of 2005 ). The 2005 Regulations are no longer required as the European Communities (Waste Electrical and Electronic Equipment) Regulations 2011 ( S.I. No. 355 of 2011 ) now give effect to the provisions of European Parliament and Council Directive 2002/96/EC as amended by European Parliament and Council Directive 2003/108/EC and by Article 5 of Directive 2008/112/EC of the European Parliament and of the Council.

These Regulations amend the European Communities Environmental Objectives (Groundwater) Regulations 2010 ( S.I. No. 9 of 2010 ). The purpose of this amendment is to facilitate the possibility of Carbon Capture and Storage following the transposition of Directive 2009/31/EC of the European Parliament and of the Council of 23 April 2009 on the geological storage of carbon dioxide.

These Regulations amend the Sea Pollution (Prevention of Air Pollution from Ships) Regulations 2010 ( S.I. No. 313 of 2010 ) on the prevention of air pollution from ships. The purpose of these Regulations is to provide for the insertion of the North American Emission Control Area in Regulations 12 and 13 of S.I. 313 of 2011, which deal with emissions of Nitrogen Oxides and Sulphur Oxides respectively.
