These Regulations provide for the provisions of Council Regulation (EC) No.1359/2008 of 28 November 2008 fixing for 2011 and 2012 the annual fishing opportunities available to Community fishing vessels for stocks of deep-sea species in Community waters and in certain non-Community waters where catch limitations are required, and the specific conditions under which such fishing opportunities may be used.

S.I. No. 465/2011 – Control of Substances that Deplete the Ozone Layer Regulations 2011

These Regulations make provisions necessary for the purposes of full and effective implementation in Ireland of Regulation (EC) No. 1005/2009 on substances that deplete the ozone layer. The main provisions of the Regulations are: Regulation 5 designation of the Environmental Protection Agency as competent authority for the purposes of Regulation (EC) No. 1005/2009; Regulation 6 designation of a number of competent bodies to administer specific provisions of Regulation (EC) No. 1005/2009 in Ireland. The competent body functions assigned to the Minister for Transport, Tourism and Sport will be administered by the Maritime Safety Directorate; Regulations 7 and 8 various requirements to be met by persons whose business involves the use of controlled substances, or the marketing, maintenance or servicing of products or equipment which contain controlled substances. The relevant waste legislation referred to in Regulation 8(1) includes in particular, but is not limited to, the following: • Waste Management (Collection Permit) Regulations 2007 ( S.I. No 820 of 2007 ) • Waste Management (Facility Permit and Registration) Regulations 2007 ( S.I. No. 821 of 2007 ); Regulation 9 various qualification requirements for persons whose business or employment involvesî • leakage control, recovery, recycling, reclamation or destruction of controlled substances; • installation, servicing, maintenance, dismantling or disposal of refrigeration, air-conditioning and heat pump equipment in which controlled substances are used; • installation, servicing, maintenance, dismantling or disposal of fire protection systems and fire extinguishers, in which controlled substances are used; and • fumigation using methyl bromide; and Regulation 10 various reporting requirements, including requirements for persons whose business involves the use of controlled substances.

S.I. No. 456/2011 – European Communities (Environmental Impact Assessment) (Agriculture) Regulations 2011

The purpose of these Regulations is to facilitate compliance with the Environmental Impact Assessment (EIA) Directive (85/337/EEC) as amended insofar as it applies to certain categories of on-farm activities, by providing for a statutory screening and consent system for these activities and also providing for EIA for such development if it is likely to have a significant effect on the environment.

S.I. No. 448/2011 – European Communities (Marine Equipment) (Amendment) Regulations 2011

The purpose of this Statutory Instrument is to transpose Commission Directive 2010/68/EU on marine equipment by 10 December 2011. The 2010 Directive amends Council Directive 96/98/EC on marine equipment by substituting a new Annex A. The principal requirement of these Directives is that the equipment placed on board an Irish ship meets the applicable requirements of the international conventions, including MARPOL (prevention of pollution), SOLAS (safety at sea), load lines and collision regulations. The relevant marine equipment is listed in Annex A. Irelandôs national legislation on marine equipment is the European Communities (Marine Equipment) Regulations 2009 ( S.I. No. 259 of 2009 ) as amended in 2010. This new Statutory Instrument further amends the 2009 Regulations to substitute an updated Annex A and provide that transitional arrangements apply until 10 December 2013 in respect of certain marine equipment that was manufactured before 10 December 2011.
