S.I. No. 54/2016 – Sea-Fisheries (Community Control System) Regulations 2016

These Regulations implement Council Regulation (EC) No. 1224/2009 of 20 November 2009 and Commission Implementing Regulation (EU) No. 404/2011 of 8 April 2011, and also give effect to the provisions of: • Council Regulation (EC) No 811/2004 of 21 April 2004 establishing measures for the recovery of the Northern Hake stock; • Council Regulation (EC) No. 1342/2008 of 18 December 2008 as amended by Council Regulation (EU) No. 1243/2012 of 19 December 2012 establishing a long-term plan for cod stocks and the fisheries exploiting those stocks, and • Regulation (EU) 2015/812 of the European Parliament and of the Council of 20 May 2015 as regards the landing obligation, as they relate to fisheries control systems and rules for the recording of fish catches and are made under the Sea-Fisheries and Maritime Jurisdiction Act 2006

S.I. No. 42/2016 – European Union (Restriction of Certain Hazardous Substances in Electrical and Electronic Equipment) (Amendment) Regulations 2016

These Regulations amend the European Union (Restriction of Certain Hazardous Substances in Electrical and Electronic Equipment) Regulations 2012 ( S.I. No. 513 of 2012 ) in order to give effect to the provisions of the following Commission Delegated Directives: (a) Commission Delegated Directive (EU) 2015/573 of 30 January 2015 amending, for the purposes of adapting to technical progress, Annex IV to Directive 2011/65/EU of the European Parliament and of the Council as regards an exemption for lead in polyvinyl chloride sensors in in-vitro diagnostic medical devices; (b) Commission Delegated Directive (EU) 2015/574 of 30 January 2015 amending, for the purposes of adapting to technical progress, Annex IV to Directive 2011/65/EU of the European Parliament and of the Council as regards an exemption for mercury in intravascular ultrasound imaging systems.

This Order establishes, on 18 January 2016, the Climate Change Advisory Council to perform the functions assigned to it under the Climate Action and Low Carbon Development Act 2015 .

S.I. No. 24/2016 – Waste Management (Collection Permit) (Amendment) Regulations 2016

These Regulations amend the Waste Management (Collection Permit) Regulations 2007 to give effect to national waste policy regarding the regulation of the collection of household waste. Primarily, the regulations provide for the introduction of pay by weight charging for the collection of household waste from 1 July, 2016. 1 O.J. No. L300, 14.11.2009, p.1. 2 The Connacht Ulster region consists of the administrative areas of Cavan, Donegal, Galway, Leitrim, Mayo, Monaghan, Roscommon, and Sligo County Councils and Galway City Council. 3 The Eastern & Midlands Region consists of the administrative areas of Dun Laoghaire-Rathdown, Fingal, Longford, Westmeath, Kildare, Offaly, Louth, Laois, Meath, Wicklow and South Dublin County Councils and Dublin City Council. 4 The Southern Region consists of the administrative areas of Carlow, Cork, Clare, Kerry, Kilkenny, Tipperary and Wexford County Councils, Limerick City and County Council, Waterford City and County Council and Cork City Council.ù, 5 The definition of úcollectionù under the Act and the Waste Framework Directive 2008/98/EC, includes the preliminary storage of waste, which is understood as a storage activity pending its collection in facilities where waste is unloaded in order to permit its preparation for further transport for recovery or disposal elsewhere. It is from this first unloading point, including any sorting, bulking, onward transport costs, to final treatment that the minimum cost has been calculated.

S.I. No. 7/2016 – Sea-Fisheries (Conservation and Rational Exploitation of Hake) (Amendment) Regulations 2016

These Regulations amend The Sea Fisheries (Conservation and Rational Exploitation of Hake) Regulations 2006 ( S.I. No 179 of 2006 ) which provide for technical control measures on Hake, as amended, to adopt the measures in Commission Implementing Regulation (EU) 2015/1897 of 21 October 2015 concerning unintended catches subject to the landing obligation requirement of the Common Fisheries Policy.

The area known as Myross Wood Special Area of Conservation 001070 is situated in the county of Cork being the land and waters enclosed on the map (contained in Schedule 1) within the inner margin of the red line and hatched in red and is situated in whole or in part in the townlands of Ardagh (E.D. Myross) and Brade.

S.I. No. 633/2015 – Air Pollution (Fixed Payment Notice) Regulations 2015

These Regulations set out the form to be used by authorised persons when issuing fixed payment notices for breaches of certain provisions of the Air Pollution Act 1987 (Marketing, Sale, Distribution and burning of Fuels) Regulations 2012, relating to the marketing, sale, distribution and burning of certain fuels. The relevant offences are set out in column 3 of the form in the Schedule to these Regulations. The fixed payment notice amounts are set out in column 5 of the Schedule to these Regulations. A prosecution in respect of the alleged offence will not be instituted by a local authority for 21 days after the issuing of a notice. There is no requirement to pay the fixed payment notice. If the fixed payment notice is not paid within 21 days then the local authority that issued the notice may institute a prosecution under the Air Pollution Act 1987 in respect of the alleged offence. A person found guilty of an offence under the Air Pollution Act 1987 , on summary conviction, shall be liable to a class A fine (set at 5,000 at the time these Regulations were signed) or to imprisonment for a term not exceeding six months, or both.
