S.I. No. 373/2016 – Waste Management (Fixed Payment Notice) (Producer Responsibility) Regulations 20

Producer Responsibility Initiatives have been developed for a number of waste streams, based on the polluter pays principle, including Waste Electrical and Electronic Equipment (WEEE), batteries, packaging and end-of-life vehicles (ELVs). These Regulations set out the form to be used by authorised persons when issuing fixed payment notices for breaches of certain provisions of Producer Responsibility Regulations.

S.I. No. 372/2016 – European Union (Waste Directive) (Recovery Operations) Regulations 2016.

These Regulations provide for measures to protect the environment and human health by preventing or reducing the adverse impacts of the generation and management of waste and by reducing overall impacts of resource use and improving the efficiency of such use and transpose Directive 2008/98/EC of the European Parliament and of the Council of 19 November 2008 on waste and repealing certain directives. In particular, these Regulations provide for the transposition of Commission Directive (EU) No. 2015/1127 of 10 July 2015 amending Annex II to Directive 2008/98/EC of the European Parliament and of the Council on waste and repealing certain directives.

S.I. No. 358/2016 – Sea-Fisheries Protection Authority (Employees) Superannuation Scheme 2016

The purpose of these Regulations is to adopt the Rules set out in the Schedule to the Rules for Pre-existing Public Service Pension Scheme Members Regulations 2014 ( S.I. No. 582 of 2014 ) as a scheme for the granting of superannuation benefits to or in respect of members of the staff of the Sea-Fisheries Protection Authority. These Regulations also revoke the Sea-Fisheries Protection Authority Staff Superannuation Scheme 2013.

S.I. No. 352/2016 – European Union (Framework for Maritime Spatial Planning) Regulations 2016

The purpose of these regulations is to give effect in Irish law to Directive No. 2014/89/EU of the European Parliament and of the Council of 23 July 2014 establishing a framework for maritime spatial planning. The primary purpose of the Regulations is to establish the necessary legal basis for the Minister to implement maritime spatial planning. The Regulations designate the Minister as the competent authority for the purposes of the Directive and provide the broad framework within which the Minister will implement maritime spatial planning.

S.I. No. 347/2016 – Air Pollution Act (Fixed Payment Notice) (Solvents) Regulations 2016.

These Regulations set out the form to be used by authorised persons when issuing fixed payment notices for breaches of certain provisions of the European Union (Installations and Activities Using Organic Solvents)) Regulations 2012. The relevant offences are set out in column 3 of the form in the Schedule to these Regulations. The fixed payment notice amounts are set out in column 5 of the Schedule to these Regulations. A prosecution in respect of the alleged offence will not be instituted by a local authority for 21 days after the issuing of a notice. There is no requirement to pay the fixed payment notice. If the fixed payment notice is not paid within 21 days then the local authority that issued the notice may institute a prosecution under the Air Pollution Act 1987 in respect of the alleged offence. A person found guilty of an offence under the Air Pollution Act 1987 , on summary conviction, shall be liable to a class A fine (set at 5,000 at the time of these Regulations were signed) or to imprisonment for a term not exceeding six months, or both.
