S.I. No. 390/1979 – The European Communities (Waste) Regulations, 1979

These Regulations give effect to Council Directive of the European Communities of 15 July, 1975 (75/442/EEC)* on waste. The Regulations make local authorities responsible for the planning, organisation, authorisation and supervision of waste operations in their areas and require them to prepare plans. A person other than a public waste collector must have a permit from a local authority for treating, storing or tipping waste in their area on behalf of another person. A holder of waste must not permit its disposal by another person except a public waste collector or a permit holder. If he disposes of the waste himself he is prohibited from doing so in a manner which would endanger human health or harm the environment. Summary conviction of an offence renders a person liable to a fine of not more than £600 or 6 months imprisonment or both. Penalties are also provided for failure to keep or produce a proper register of waste operations or to give relevant information to an authorised person and for obstructing or interfering with such person.

S.I. No. 388/1979 – The European Communities (Waste) (No. 2) Regulations, 1979

These Regulations give effect to Council Directive of the European Communities of 6 April, 1976 (76/403/EEC)* on the disposal of polychlorinated biphenyls and polychlorinated terphenyls. These substances or mixtures containing them are described as PCB and have been or are being used for various purposes including use in electrical equipment such as transformers, resistors, inductors and condensers and used as heat-transmitting fluids in closed-circuit heat-transfer installations. The purpose of these Regulations is to secure safe disposal of waste PCB, including PCB contained in objects or equipment no longer capable of being used. Discharge, dumping or tipping in a manner which would endanger human health or harm the environment is prohibited and summary conviction of an offence renders a person liable to a fine not exceeding £600 or 6 months imprisonment or both. The Electricity Supply Board is designated as an authority which is authorised to dispose of PCB. Holders of waste PCB must notify the designated authority and make it available for disposal by them. The authority must maintain a register of notifications and of waste held or disposed of and must furnish information required by the Minister. The Regulations also enable duly authorised persons to investigate whether the Regulations are being complied with and conviction of obstruction or interference with such investigation renders a person liable to a fine not exceeding £250.

S.I. No. 369/1979 – Oil Pollution of the Sea (Intervention Convention Countries) Order, 1979

This Order declares that the International Convention relating to Intervention on the High Seas in Cases of Oil Pollution Casualties, 1969 has been accepted by the countries specified in Part I of the Schedule to the Order and that the Convention extends to the Territories specified in Part II of the Schedule.

S.I. No. 318/1979 – Oil Pollution of the Sea (Amendment) Act, 1977 (Application of Section 2) Order, 1979

This Order applies Section 2 of the Oil Pollution of the Sea (Amendment) Act, 1977 to ships registered in a country, which has accepted the International Convention Relating to Intervention on the High Seas in Cases of Oil Pollution Casualties, 1969 when such ships are outside the territorial seas of the State.

S.I. No. 235/1979 – Wildlife Act, 1976 (Control of Export of Fauna) Regulations, 1979

The effect of these Regulations is to prohibit the export, except under licence from the Minister for Fisheries and Forestry, of certain specified wild birds and wild animals live or dead (including game species) and specified parts or products of certain wild birds and wild animals. Nothing in the Regulations restricts, prejudices or affects the Live Pigeons (Prohibition of Export) Order, 1971 ( S.I. No. 138 of 1971 ) which prohibits the export, except under licence from the Minister for Agriculture, of live pigeons to places other than Northern Ireland.

The Partridge, Pheasant and Grouse (Regulation of Export) Order, 1962 ( S.I. No. 151 of 1962 ) relating to the prohibition on export, except under licence from the Minister for Agriculture, of those three species of game birds is revoked as from 7th August, 1979.
