S.I. No. 25/1990 – Local Government (Planning and Development) Regulations, 1990

These Regulations make provisions in connection with the incorporation into planning control procedures of Directive 85/337/ EEC on the assessment of the effects of certain public and private projects on the environment and establish an environmental impact assessment procedure for development carried out by or on behalf of local authorities.

S.I. No. 31/1990 – European Communities (Control of Water Pollution by Asbestos) Regulations, 1990

These Regulations give effect to the water pollution control provisions of Council Directive No. 87/217/EEC of 19 March 1987, (O.J. No. L85/40, 28 March 1987) on the prevention and reduction of environmental pollution by asbestos. The Regulations impose a general obligation to prevent the entry of asbestos to waters and specify the measures to be applied to certain industrial plant using asbestos. They also provide for the monitoring of effluent discharges from industrial plant.

S.I. No. 24/1990 – Road Traffic (Removal, Storage and Disposal of Vehicles) (Amendment) Regulations, 1990

These Regulations amend the Road Traffic (Removal Storage and Disposal of Vehicles) Regulations, 1983 by increasing from £20 to £50 the charge for the release of a vehicle payable to a road authority or the Garda Commissioner by the owner of a vehicle which has been towed away in accordance with the Regulations and by increasing from £2 to £15 per day the storage charge payable for the period during which such vehicles have been stored.

Number 14 of 1990 – Derelict Sites Act, 1990

An act to make provision with respect to land to prevent it being or becoming a derelict site, to enable local authorities to require the taking of measures on derelict sites by the owners or occupiers and, in certain circumstances, to acquire derelict sites compulsorily, to establish registers of derelict sites, to enable the minister to give directions in relation to derelict sites, to provide for a derelict sites levy and to rovide for other matters connected with the afore said and to repeal the derelict sites act, 1961. S.I. No. 106/1989 – Nature Reserve (Tralee Bay) Establishment Order, 1989

The Order, establishes an area of land comprising part of Tralee Bay in the County of Kerry as a nature reserve so that it can be managed in such a way as to ensure the conservation of the marine ecosystem which it constitutes.

S.I. No. 349/1989 – European Communities (Environmental Impact Assessment) Regulations, 1989

These Regulations provide for the incorporation into Irish law, in respect of relevant development other than motorways, of Directive 85/337/EEC on the assessment of the effects of certain public and private projects on the environment. Effect was given to this Directive in respect of motorways by the European Communities (Environmental Impact Assessment) (motorways) Regulations, 1988 ( S.I. No. 221 of 1988 ).

The Regulations modify the provisions of the Local Government (Planning and Development) Acts, 1963 to 1983 so as to provide a framework for the application of Environmental Impact Assessment (EIA) to the planning control procedures under those Acts, and for the application of EIA to relevant development by local authorities. They also modify development consent procedures under 9 other enactments in light of the Directive’s requirements, and they establish an EIA procedure for relevant development by State authorities. The Regulations specify, in the First and Second Schedules respectively, the development for which EIA will be required and the information which must be furnished in an environmental impact statement prepared in connection with proposed development.

S.I. No. 333/1989 – Air Pollution Act, 1987 (Retail Sale of Fuels) Regulations 1989

These Regulations require retailers of bituminous coals in the built up area of Dublin to have a supply of one or more specified smokeless or low-smoke solid fuels for sale by retail from vehicles or at premises, as appropriate. The requirements do not apply to vehicles being used solely for delivering coals on foot of a prior order or orders therefor. The Regulations come into operation on 1st January, 1990.
