An Act to make provision for the prevention of pollution of the sea by oil and other substances; and to give effect to the international convention for the prevention of pollution from ships done at London on the 2nd day of November, 1973, as amended by the protocol done at London on the 17th day of February, 1978; and to give effect to the protocol relating to intervention on the high seas in cases of pollution by substances other than oil done at London on the 2nd day of November, 1973; and to provide for the repeal of The Oil Pollution Of The Sea Acts, 1956 To 1977; and to provide for other matters related to the foregoing matters.

SECTION 33 Slaughter of animals, etc., destruction of crops, etc. and disposal of eggs, fish, etc.33.(1) The Minister for Agriculture and Food may cause to be slaughtered any animals, fauna or poultry affected by levels of activity which exceed the specified levels and may cause the carcases of the said animals, fauna or poultry to be disposed of as he thinks fit.

2) The Minister for Agriculture and Food may cause to be destroyed any eggs, crops, carcases, feeding stuffs, bottled water or other food affected by levels of activity which exceed the specified levels and may cause the ashes or other remains of the eggs, crops, carcases, feeding stuffs, bottled water or food so destroyed to be disposed of as he thinks fit.

(3) The Minister for the Marine may cause to be destroyed any fish, fishery products or seaweed affected by levels of activity which exceed the specified levels and may cause such destroyed fish, fishery products or seaweed to be disposed of as he thinks fit

(4) The Minister for Finance may cause to be destroyed any fauna affected by levels of activity which exceed the specified levels and may cause such fauna so destroyed to be disposed of as he thinks fit.

S.I. No. 323/1990 – Arterial Drainage Acts, 1945 and 1955 (Environmental Impact Assessment) Regulations, 1990

These Regulations prescribe bodies to which copies of an environmental impact statement prepared in respect of proposed arterial drainage works must be sent and, as such, give effect to the provisions of the European Communities (Environmental Impact Assessment) Regulations, 1989 ( S.I. No. 349 of 1989 )).

S.I. No. 297/1990 – European Communities (Construction Plant and Equipment) (Permissible Noise Levels) (Amendment) Regulations, 1990

The purpose of these Regulations is to give legal effect to Commission Directive 89/514/EEC, adapting to technical progress Council Directive 86/662/EEC on the limitation of noise emitted by hydraulic excavators, rope- operated excavators, dozers, loaders and excavator-loaders. The Commission Directive prescribes a revised form of test method for measuring the noise levels of the equipment in question.

S.I. No. 220/1990 – Foreshore (Environmental Impact Assessment) Regulations 1990

These Regulations provide, insofar as applications for leases and licences under Sections 2 and 3 of the Foreshore Act 1933 to carry out developments on the foreshore are concerned, for prescribed times for consideration of Environmental Impact Statements provided further to the European Communities (Environmental Impact Assessment) Regulations 1989 and lists prescribed bodies to whom the Environmental Impact Statements will be provided for comment.

S.I. No. 157/1990 – European Communities (Protection of Workers) (Exposure To Noise) Regulations, 1990

These Regulations implement Council Directive No. 86/188/EEC on the protection of workers from the risks related to exposure to noise at work

The Regulations provide for:

assessment and measurement of noise levels at work,

provision of information training and instruction for workers exposed to noise exceeding specified levels,

identification of areas where noise exceeds specified levels,

reduction of risks resulting from exposure to noise,

provision of personal ear protectors where necessary

periodic hearing checks for workers exposed to specified noise levels,

maintenance of records of noise levels,

maintenance of records of hearing checks,

inspection of records by specified persons,

penalties for breach of the Regulations

These Regulations replace the Factories (Noise) Regulations, 1975 (S.I. No. 235 of 1975

S.I. No. 123/1990 – Air Pollution Act, 1987 (Marketing, Sale and Distribution of Fuels) Regulations, 1990

These Regulations bring into effect from the 1st September, 1990 a prohibition on the marketing, sale and distribution of bituminous coals within the restricted area of Dublin and set certain standards for allowable fuels within that area. The prohibition does not apply to certain operations involving the storage of prohibited fuels within the area and their transport or delivery through the area. The Regulations make provision for their enforcement by Dublin Corporation, Dublin County Council and Dun Laoghaire Corporation within their respective functional areas and provide controls in that regard (keeping and examination of records etc.).

The Regulations also revoke, with effect from 1st September, 1990, the Air Pollution Act, 1987 (Retail Sale of Fuels) Regulations, 1989 which require retailers of bituminous coals within the built-up area of Dublin to have a supply of one or more specified solid fuels for sale by retail.
