S.I. No. 294/1993 – Air Pollution Act, 1987 (Marketing, Sale and Distribution of Fuels) (Cork) Regulations, 1993

These Regulations require retailers of bituminous coals in the built-up area of Cork to have a supply of one or more specified smokeless or low-smoke solid fuels for sale by retail from vehicles or at premises, as appropriate. The Regulations also bring into effect a prohibition on the placing on the market, sale or distribution of bituminous slack and provide for other procedural matters in relation to enforcement. The Regulations come into effect on 18th October, 1993.

S.I. No. 276/1993 – European Communities (Protection of Workers) (Exposure To Asbestos) (Amendment) Regulations, 1993

The purpose of these Regulations is to implement Council Directive 83/477/EEC as amended by Directive 91/382/EEC on the protection of workers from the risks related to exposure to asbestos at work.

The Regulations amend the European Communities (Protection of Workers) (Exposure to Asbestos) Regulations, 1989 ( S.I. No. 34 of 1989 ), which apply to all work which exposes persons to risk arising from the inhalation of asbestos.

The Regulations aim to protect the health of employees by reducing the level of exposure to asbestos fibres in the workplace, by setting lower exposire limits for asbestos fibre concentrations in air and banning the use of low density asbestos materials. The Regulations also amend the requirements of the plan which must be prepared in advance of any demolition work involving asbestos

S.I. No. 151/1993 – Radiological Protection Act, 1991 (General Control of Radioactive Substances, Nuclear Devices and Irradiating Apparatus) Order, 1993

This Order has the effect of revoking and replacing the Nuclear Energy (General Control of Fissile Fuels, Radioactive Substances and Irradiating Apparatus) Order, 1977 ( S.I. No. 166 of 1977 ).

It provides for the control by licence, to be obtained from the Radiological Protection Institute of Ireland, of the custody, transportation, handling, holding, storage, use, manufacture, production, processing, importation, distribution, exportation, or other disposal of radioactive substances, nuclear devices or irradiating apparatus, as defined in the Order.

This Order also completes the implementation of Council Directive 80/836/Euratom of 15 July, 1980, as amended by Council Directive 84/467/Euratom of 3 September, 1984, laying down the basic safety standards for the health protection of the general public and workers against the dangers of ionising radiation.

These regulations set out the procedures for public access to information relating to the environment held by public authorities in accordance with the provisions of Council Directive of June, 1990, No. 90/313/EEC (O.J. No. L158/56 of 23 June, 1990) on the Freedom of Access to Information on the Environment. The Regulations also provide certain grounds for refusal of information and establish other procedures relevant to processing of requests by public authorities

Number 14 of 1993 – Roads Act, 1993

An act to provide for the construction and maintenance of public roads, to establish a national roads authority, to provide for motorways, busways and protected roads, to provide for the tolling of public roads and to provide for other matters connected with the matters aforesaid [26th June, 1993]

Road traffic noise

(1) The Minister may, after consultation with the Environmental Protection Agency, make regulations requiring road authorities or the Authority to carry out works or take such other measures as are necessary to mitigate the effects of road traffic noise in respect of such types of public road constructed or improved after the commencement of this section as are specified in the regulations.

(2) Without prejudice to the generality of subsection (1), regulations under this section may?

( a ) make different provisions for different classes of cases (which may be defined by reference to classes of areas in which a public road or roads are situate, classes of persons whom the mitigation of the effect of road traffic noise is intended to benefit or such other matters as the Minister thinks appropriate),

( b ) specify limits for road traffic noise in respect of a public road above which road authorities or the Authority will be required to carry out works or other measures of the kind referred to in subsection (1),

c ) specify methods of, arrangements for, and any other matters relating to, the measurement of road traffic noise,

d ) specify standards in respect of works and other measures of the kind referred to in subsection (1).
