S.I. No. 45/1994 – Sea Pollution (Prevention of Pollution by Garbage From Ships) Regulations, 1994

These Regulations give effect to Annex V of the International Convention for the Prevention of Pollution from Ships, adopted by the International Maritime Organisation on 2 November, 1973 and as amended by its Protocol adopted on 17 February, 1978, and as further amended by the Marine Environment Protection Committee (MEPC) of the International Maritime Organisation under Reslutions which designated the North Sea, the Antarctic area (south of latitude 60?S) and the Wider Caribbean Region as "special areas".

The Regulations apply to all Irish ships wherever they may be and to all other ships when they are in the territorial seas and inland waters of the State.

The Regulations prohibit and control the disposal of garbage into the sea in accordance with the type of garbage for disposal and the geographical location of the ship. They also provide for the availability of adequate facilities at ports and terminals for the reception of garbage.

Section 29 of the Sea Pollution Act, 1991 provides for penalties for breaches of these Regulations.

S.I. No. 44/1994 – Sea Pollution (Prevention of Oil Pollution) Regulations, 1994

These Regulations give effect to Annex I of the International Convention for the Prevention of Pollution from Ships, adopted by the International Maritime Organisation on 2 November, 1973 and as amended by its Protocol adopted by the International Maritime Organisation on 17 February, 1978 and as further amended under resolutions adopted by the Marine Environment Protection Committee (MEPC) of the International Maritime Organisation.

The Regulations apply to all Irish ships wherever they may be and to all other ships when they are in the territorial waters of the State.

The Regulations prohibit and control discharge into the sea of oil and oily mixtures. The Regulations require ships to follow specified procedures when washing cargo tanks. Ballasting arrangements and the discharge of ballast water are also controlled. The Regulations also provide for adequate facilities at ports and terminals for the reception of oil and oily mixtures.

Ships are required to be surveyed for the purposes of the Regulations and to carry an International Pollution Prevention Certificate. Ships are also required to carry an Operations and Equipment Manual, an Oil Record Book and a shipboard oil pollution emergency plan approved by the Minister.

Section 29 of the Sea Pollution Act, 1991 provides for penalties for breaches of these Regulations.

S.I. No. 43/1994 – Local Government (Water Pollution) Acts, 1977 and 1990 (Control of Carbon Tetrachloride, Ddt and Pentachlorophenol Discharges) Regulations, 1994

These Regulations prescribe quality standards to be applied by local and sanitary authorities when licensing discharges of effluents containing carbon tetrachloride (CC14), DDT and pentachlorophenol to waters or to sewers under the provisions of the Local Government (Water Pollution) Act, 1977 as amended by the Local Government (Water Pollution) (Amendment) Act, 1990 . The Regulations give effect to Council Directive No. 86/280/EEC on limit values and quality objectives for discharges of certain dangerous substances included in List I of the Annex to Council Directive 76/464/EEC.

S.I. No. 347/1993 – Air Pollution Act, 1987 (Municipal Waste Incineration) Regulations, 1993

The Regulations give effect to Council Directive 89/369/EEC of 8 June, 1989 on the prevention of air pollution from new municipal waste incineration plants. They prescribe emission limit values for specified pollutants and give directions as to the best practicable means for limiting the emissions concerned. The Regulations also specify conditions in regard to the emission limit values and the monitoring and operating of plants
